Courts Are Fallible!

Can you imagine a contract being given by a popular cine actor to a gangster for executing a revenge crime against a prominent fellow actress by having her abducted, sexually assaulted, and photographed in a moving vehicle!

 
The court hearings in this 2017 sexual assault case, even after 5 years, is still going on in a special court in Kerala. Now the same cine actor is alleged to have hatched a conspiracy to kill the police officers who were investigating the actress sexual assault case against him. A person with such an alleged track record of planning two conscience-pricking mega crimes is given pre-arrest bail yesterday by a Kerala High Court judge so that the cine actor cannot be taken into custody for questioning by the police.

The process of granting the anticipatory bail by the honorable judge occurred after the course of several hearings, including two long ones held on Saturdays. Again, an unheard of practice in a bail hearing.

While pronouncing the order, the judge quoted Justice Robert Jackson of US Supreme Court who famously quipped, “We are not final because we are infallible, but we are infallible only because we are final.”

This is intended to convey the message that even the highest court in the country has no claim that it is infallible. It is as if the honorable judge has already sought an anticipatory bail for himself in case the Supreme Court on appeal overrules his judgement!
